RENTAL RULES AND REGULATIONS & EXTENUATING CIRCUMSTANCES POLICY (ECP)
A. RENTAL RULES AND REGULATIONS
GENERAL TERMS & CONDITIONs
1. CHECK-IN TIME IS AFTER 3:00pm; CHECK-OUT TIME 12:00 mid-day.
2. This is a NON SMOKING property.
3. Pets are not permitted under any conditions. We will not rent to vacationing students or singles under 21 years of age unless accompanied by an adult guardian or parent. Management reserves the right to refuse its service to anyone

5. MAXIMUM OCCUPANCY - The maximum number of guests per apartment is determined by the size of the apartment being rented. An additional apartment may be required for additional guest.
6. MINIMUM STAY – This property requires a 3 night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.
7. INCLUSIVE FEES - Rates include a one-time linen-towel setup. Amenity fees are included in the rental rate
8. NO DAILY MAID SERVICE - While linens and bath towels are included in the unit; daily maid service is not included in the rental rate unless otherwise stated and therefore may incur additional charge. We do not permit bath towels or linens to be taken from the apartments. Beach towels can used at the beach.
9. RATE CHANGES - Rates are subject to change without notice.
10. FALSIFIED RESERVATIONS - Any reservation obtained under false pretence will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
11. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance by management.
12. DAMAGE / SECURITY DEPOSIT
If credit card details have not been provided on or before check-in a Damage / Security deposit of $200 cash is required.
a. This must be received at check-in. This deposit is NOT applied towards your invoice; however, it is fully refundable on / within 14 days of check-out, provided the following provisions are met.
b. No damage will charge to guest for normal wear and tear to unit or its contents.
c. Guest will be charged for damaged furniture, torn / badly stained / lost linen.
d. Guest will be charged if debris, rubbish and discards are NOT placed in trash receptacle provided, if appliances are found broken, windows, doors, furniture are found to be broken.
e. Guest will be charged if all keys and room cell phone are not left at the front desk, or with the duty manager during check-out.
f. All charges accrued during the stay are paid on, or before, check-out.
g. Property owners / management are not responsible for accidents, or injury, to guests, or for loss of money, jewelry or valuables of any kind, or for any item left in the room.
HURRICANE OR STORM
1. No refunds will be given unless:
a. The National Emergency Management Organization (NEMO) orders mandatory evacuation for a region during a Tropical Storm/Hurricane Warning period
b. A mandatory evacuation order has been given by NEMO, during a Tropical Storm/Hurricane warning period, for residence and vacationing guest housed within a specified location / property;
2. The day that the NEMO issues a mandatory evacuation order during a Tropical Storm/Hurricane Warning, Bayside Villa St. Lucia will refund:
a. Any unused portion of rent from guest currently checked in;
b. Any unused portion of rent from guest scheduled to arrive;
c. Any unused portion of rent from guest wanting to shorten their stay, i.e.,checking-in after the Tropical Storn/Hurricane warning has been lifted.
AIRPORT TRANSFER
If BAYSIDE VILLA ST. LUCIA arranges the transfer to / from ports of entry the following applies;
1. Airport SLU (George F. L. Charles Airport), 5 – 10 min. drive US$25 per car one way; a maximum of 2 persons per car. US$10 each for each additional person
2. Airport UVF (Hewranorra Int. Airport), 1 hr. drive US$75 per car one way; a maximum of 2 persons per car. US$10 each for each additional person.
3. The Transfer must be paid to the transfer driver directly unless collected by BAYSIDE VILLA St. Lucia during the reservation confirmation process.
4. The transfer includes a complementary supermarket stop before / after check-in.
5. If guest arrival / check-in occur after working hours, the complementary supermarket stop will be re-scheduled for the following business day.
5. Upon exiting the airports arrival hall guest are to look for someone holding up the BAYSIDE VILLA St. Lucia sign for assistance. The person holding up the sign will be the transfer driver.
RESERVATION CONFIRMATION & PAYMENT
i. To "confirm a reservation" an advance payment equal to 100% of the "rental invoice" total is required.
ii. The advance payment is not a damage / security deposit.
iii. Additional charges accrued during the vacation period are to be settled in full prior to check-out.
CANCELLATIONS
i. The guest will be charged 100% of the total price if they cancel the reservation;
ii. Note, an early departure does not warrant any refund of payments.
iii. No-shows are subject to a penalty equal to 100% of the total cost of the stay.
RENTERS LIABILITY
By signing below renters agree that their liability for the attached invoice is not waived, and renters agree to be held personally liable in the event the indicated person, or company, failed to pay any part, or full amount, of these charges including any missing / damaged items, etc., over and above the security/damage deposit. If an attorney, or collection agency, is retained to collect these charges, the renter will pay all reasonable costs incurred. If payment is by credit card you management is authorized to charge the renters card for all charges incurred
B. EXTENUATING CIRCUMSTANCES POLICY and the corona virus (COVID-19)
Overview
The following discussion on ECP is applies to our guest making reservations on our direct website address www.baysidevillastlucia.com. All other booking sites that we are listed on have a similar policy in place which we have to agree to in order to remain listed.
On March 11, 2020, the World Health Organization (WHO) declared the outbreak of corona virus, known as COVID-19, to be a global pandemic. Since then, the outbreak has evolved rapidly with governments around the world taking swift action to slow the spread of COVID-19. In response we are providing the following for the COVID-19 impact under our Extenuating Circumstances Policy (ECP) to help protect our guests and ourselves.
Extenuating Circumstances Policy (ECP) Summary
What reservations are covered?
Reservations made after March 14, 2020
• Guests with reservations for stays at BSV, made after March 14, 2020 will not be covered under our extenuating circumstances policy. COVID-19 related circumstances not covered include:
1. transportation disruptions and cancellations;
2. travel advisories and restrictions;
3. health advisories and quarantines;
4. changes to applicable law; and other government mandates—like evacuation orders, border closures, prohibitions on short-term rentals, and shelter-in-place requirements;
5. Illnesses in general (COVID-19 included).
In the above five listed COVID-19 related circumstances not covered our BSV Rental Rules & Regulations Cancellation Policy currently in place will take effect in this situation. Said Rental Rules & Regulations can be reviewed during the reservation process, and must be agreed to before confirming the reservation.
Conclusion
After the declaration of COVID-19 as a global pandemic by the World Health Organization, our ECP no longer applies to COVID-19, because its consequences are no longer unforeseen or unexpected.
Our ECP, although no longer providing COVID-19 protection as explained above, remains to protect guests and hosts from other unforeseen circumstances that arise after booking.
As of January 2021 our ECP protection details what unforeseen events, beyond your control that can arise after booking, and make it impracticable, or illegal, to complete your reservation. In these situations the ECP takes precedence over the reservation’s General Cancellation Policy.
Guests that are impacted by an event covered by this ECP can cancel their reservation and receive, depending on the circumstances, a cash refund, travel credit, and/or other consideration in discussion with BSV management.
Further if BSV is impacted by an event covered by this ECP they can also cancel guests reservations and issue a cash refund, travel credit, and/or other consideration in discussion with BSV management.
What events are covered
Following are the listed “Events” (situations) that can occur after booking, that are unforeseen at the time of booking, and prevent or legally prohibit completion of the reservation.
• Changes to government travel requirements. Unexpected changes to visa or passport requirements imposed by a governmental agency that prevent travel to the destination. This doesn’t include lost or expired travel documents or other personal circumstances relating to a guest’s authorization to travel.
• Declared emergencies and epidemics. Government declared local or national emergencies, epidemics, pandemics (excludes COVID-19), and public health emergencies. This does not include diseases that are endemic or commonly associated with an area—for example, malaria in Thailand or dengue fever in Hawaii.
• Government travel restrictions. Travel restrictions imposed by a governmental agency that prevent or prohibit traveling to, staying at, or returning from the Listing location. This does not include non-binding travel advisories and similar government guidance.
• Military actions and other hostilities. Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, rebellions, riots, insurrection, civil disorder, and civil unrest.
• Natural disasters. Natural disasters, acts of God, large-scale outages of essential utilities, volcanic eruptions, tsunamis, and other severe and abnormal weather events. This does not include weather or natural conditions that are common enough to be foreseeable in that location—for example, hurricanes occurring during hurricane season in Florida.
What is not covered
Our ECP only allows for cancellations for the Events described above. Everything else is excluded. Examples of situations that this Policy does not allow cancellations for include:
• unexpected disease, illness, or injury;
• government obligations like jury duty, court appearances or military duties;
• travel advisories or other government guidance (that fall short of a travel ban or prohibition);
• cancellation or rescheduling of an event for which the reservation was made;
• and transportation disruptions unrelated to a covered Event like road closures, as well as flight, train, bus and ferry cancellations.
• emergencies (e.g., death, illnesses)
If you cancel a reservation in these cases, the amount refunded will be determined by the BSV General Cancellation Policy which is available for review before confirming your reservation.
What to do next
• If we notify you or publish information confirming that this ECP applies to your reservation, please follow the cancellation instructions that we provide. Cancellation under this ECP is completed discussion with BSV management.
• If you believe this Policy applies to your reservation, but we have not notified you or published information about the Event, please contact us promptly to cancel your reservation. In all cases, you should be prepared to provide documentation that shows how the Event has impacted you or your reservation.
• If you have questions, please contact us.
Other things to be aware of
This ECP applies to all reservations before the check-in date. In other words, it is not applicable to reservations on, or after, the check-in date.
